Update on Legal Action

Unfortunately BANES refused to listen to local residents and so we were forced to initiate legal action on 29 July 2024. It was not too late for them to pull back and we requested a meeting with our local councillors and the Cabinet Member for Transport, Cllr Manda Rigby.
On 7 August, just 5 minutes before the deadline for filing their defence, the Council conceded they were wrong and so WE WON our case with OUR COSTS awarded against them.
It did not need to happen, we asked them time and again to talk to us but they refused and so they have squandered over £100,000 of your money because of ideology.
Thank you to all of you who supported us, without you we would not have been able to hold them to account.
BANES have written to us stating that they will reply to our requests to meet by the end of August. Sadly, we subsequently received an email from the Council Leader's office requesting that we stop contacting him.
"We acknowledge your statement about the strength of local feeling against the Winifred’s Lane scheme. However, to provide a more balanced view, since the injunction hearings the Council has received contact by local people and organisations who have been motivated to get in touch with us. They are voicing support for the trials in Lower Lansdown and have expressed disappointment that they have been paused. As stated in our press release, it is our intention to relay a new ETRO in due course."
Cllr Rigby has yet to respond.
